Builder’s delay in issuance of demand letter to be submitted to Bank against sanctioned loan even after 2 year?
A. I booked a flat at Dombiveli , Greater Navi Mumbai on 21-03-2010 from a reputed Builder with that understanding that my EMI would start within a year against the Home Loan to be taken. B. Accordingly, I made the payments (15% of the CV) against the demand within 21days and 42 days along with the payment for Car Parking by 14-05-10. C. My Home loan was sanctioned on 07-05-2010 and the Sanctioned letter was scanned and sent to the Builder through emails dated 16-05-2010,03-06-2010, 31-10-2011, 03-11-2011 & 24-11-2011 as time to time the same was asked by five different persons as office bearer from his end. The Allotment letter for the premises was issued to me on 03-06-2010. D. Registration was also made on 20-06-2011. Against payment of stamp duty and registration. TOTAL PAID TILL DATE: Rs. 436507/- ( to Builder against 1st. & 2nd. Demand, Car Parking, MVAT, Service Tax) + Rs. 1, 81,920/- (Stamp Duty & Registration) = Rs, 618427 (six lac eighteen thousand four hundred twenty seven ). E. Since May 2010, I sent nine emails & eight queries (in between 29-06-2011 to 30-11-2011) through Builders website to nine different persons who were his office bearer from time to time, followed by 4 more queries (on 7/1/12, on 03-02-12, on 10-02-12 & on 29-02-12). In every query / mail I requested the Builder to issue the demand letter to be forwarded to the Bank to start my EMI against the sanctioned loan. UNFORTUNATELY, there was no DEFINITE ANSWER from him till 05-07-12 via the Builders website / email. F. Since last 3 months, I am out of my Job and my financial condition is critical. Even though I opted for the `Home Suraksha Plus plan but I am not entitled to get the advantage of the scheme as despite my SEVERAL WRITTEN REQUESTS as mentioned above Builder did not ISSUE THE DEMAND LETTER EVEN AFTER 24 MONTHS OF THE ISSUANCE OF ALLOTMENT LETTER dated 03-06-10 & 12 MONTHS AFTER THE REGISTRATION (on 20-06-11). Under these circumstances, can I get back my money already paid to the Builder and the Register office as they made the delay to start the EMI?
